The attorneys representing a woman who lost her baby after a fatal crash say they are concerned charges won't be filed against the Mayes County deputy involved in the accident.

OHP says a Mayes County deputy was on the way to an emergency call and crashed with an SUV with three people inside two miles north of Spavinaw.

One of the passengers, Kaylee Thurlo was six months pregnant and lost her baby the next day. Attorney Daniel Aizenman says he and Kaylee sat down with District Attorney Matt Ballard this week to talk about what happens next and learned a deferred prosecution deal is one option.

"If that is what they are going to do, it is simply a travesty of justice. It's nothing more than a slap on the wrist," said Aizenman.

Kaylee's attorney, along with Jeff Krigel, who represents the driver of another SUV involved in the accident, say they'd like to see charges filed against Deputy Brittney Burnett instead.

"We don't think that the treatment of Miss Burnett is the same as it would be had it been a civilian or anyone else," said Aizenman.

"This case will be treated like any other," said District Attorney Matt Ballard.

Ballard emphasizes no decision has been made yet and says there's a lot to consider in this case.

"A decision hasn't been made. We're looking at everything. it's a very complex case. We don't know whether charges, at this point, whether we'll be filing anything," said Ballard.

While everyone waits for a decision Deputy Burnett remains on paid administrative leave. The DA expects a decision could be made within the next 30 days.
