(Oklahoma City-AP) -- The Oklahoma Libertarian Party says it may take legal action after the State Election Board rejected a party member's bid for a place of the ballot in a special election to fill a state Senate seat.

Party chairman Chris Powell says the Libertarian Party may sue the state after Ed Henke, a registered Libertarian, was unable to file as a candidate in the special election to fill the District 44 seat vacated when Senator Keith Leftwich died September 19th from cancer.

The Election Board says it refused Henke's candidacy because the Libertarian Party is considered a political organization, not a political party under state election laws.

State law says a political party's candidate has to receive at least 10 percent of the votes cast in the most recent general election to be considered a party.
