The brother of a Tulsa man shot and killed by an Oklahoma Highway Patrol trooper over the weekend appeared for an arraignment in Okmulgee County court Monday.
Brandon Fischer was arrested Friday night and his brother Nehemiah was killed during what apparently started as a water rescue. The two brothers were pushing a truck from flood waters near Liberty Mounds when troopers say they ordered the men to higher ground.
OHP Captain Paul Timmons said the men argued and a trooper shot and killed Nehemiah in self-defense. He said a gun at the scene belonged to Nehemiah Fischer.
Brandon Fischer, 41, was arrested on complaints of assaulting an officer and public intoxication. The Attorney General says when questioned, Brandon Fisher admitted the brothers had been drinking while fishing earlier.

In court Monday, Brandon received a $2,000 bond for charge 1 and a $2,100.50 bond for charge 2.
His attorney said he doesn't have many facts surrounding the case but felt the bond amount was fair.
Brandon is scheduled to reappear in court at 3:00 June 25,2015.
Nehemiah Fischer was an associate pastor at Faith Bible Church in Tulsa where he had attended for 15 years. Members of the congregation, including pastor Don Hargrove, say Fischer does not fit the picture of a man who would assault an officer.OHP has not yet released the name of the trooper involved in the fatal shooting.
