A Tulsa man could be headed to trial for the death of one of three people killed in a Christmas eve car wreck in 2009. It's another case affected by the ruling on tribal jurisdiction.

A Tulsa man could be headed to trial again for the death of one of three people killed in a Christmas eve car wreck in 2009.

Steven Jameson pleaded guilty and went to prison for manslaughter, serving four and a half years.

Through a series of appeals – culminating in the Supreme Court tribal jurisdiction ruling – his state court sentence was vacated. Federal prosecutors have not picked up the case because the statute of limitations has run out.

Two of the victims in the case were native and Jameson is Cherokee, but wasn’t on the roll until a full year after the crime.

On February 18, Judge Dawn Moody ruled that because he wasn’t enrolled at the time of the wreck, his native status does not prevent a new prosecution for the death of the one non-native victim.

Linda Perkins, the mother of victim Angela Mulanax, cried outside the courtroom when the hearing was over.

“Of course, it's very emotional for us” she said, “We've been on such a roller coaster for the last 12 years trying to get justice for our children."

Her daughter, her daughter’s husband, and their son were all killed when the car they were in was hit head on by an SUV driven by Jameson.

The decision to push forward on a state prosecution will be appealed by Jameson’s attorney, likely delaying a scheduled trial date of March 28.
