The McClain County Assistant District Attorney on the case says after the most recent hearing it came to their attention that there may be a conflict of interest in the case and asked the judge to recuse himself. Judge Greg Dixon agreed.

The assistant DA says he can't comment on why they asked the judge to step down from the case but family members say the judge served on a committee with Powell's father.

You'll remember a plea and sentencing was rescheduled earlier this month because the judge said he had a previous appointment.
