A Tulsa County judge Wednesday refused to throw out the arrest of Tyrone Woodfork.
Woodfork is charged with breaking into Bob and Nancy Strait's home last year, beating them both and also raping Nancy, then stealing the couple's jewelry, TV and car. Nancy died shortly afterward and Bob passed away six weeks later.
A citizen spotted the car the day after the incident and called police.
When the officer got there, four men were standing outside the car. Woodfork was one of the those men and two witnesses told police he had been driving the couple's vehicle.
Woodfork's attorney argued, since police didn't have a warrant for his arrest, it wasn't valid.
The judge ruled there was plenty of probable cause for police to make the arrest without a warrant.
