The Oklahoma County Sheriff’s office confirms Elijah Evans was released from the Oklahoma County jail Monday night.
Oklahoma City police had arrested Evans and Gilbert Terrell last Monday in connection with the shooting death of Joseph Martin. The two were being held on a complaint of first-degree murder.
Court papers state witnesses identified two suspects involved in the shooting and a 2009 MC truck that the suspects drove up in. Witnesses advised Terrel and Evans were taking property from a campsite where the victim had been living and when they were confronted, a brief argument occurred and the victim was shot. Martin was found dead in a grassy area northwest of the intersection with a gunshot wound to the head.
Those same court papers state that Evans waived his Miranda Rights and admitted to being present with Terrel while removing the victim’s property from the camp site where he was staying near N.W. 10th and Eagle Lane, and when Terrel shot the victim. A search warrant reveals a 2009 truck belonging to Terrel had a holster in plain view in the front seat, but that the firearm was not located.
Friends and family of Joseph Martin have created a GoFundMe page. They have also created a small memorial near the spot where he was shot and killed.
