Broken Arrow Woman To Stand Trial In 3-Year-Old Foster Son's Death

A Broken Arrow woman has been bound over for trial in the death of her 3-year-old foster son.

Prosecutors charged Mallory Krajian with murdering Andrew Prior in August 2014.

A judge decided there is enough evidence for Krajian to stand trial. Her attorney said Krajian is not guilty, but the victim's family believes otherwise.

Krajian didn't have anything to say as she left the courtroom. But the relatives who still are grieving over the death of Andrew Prior did.

“It makes me feel horrible,” said the child's great aunt Lois Richie. “It makes me feel deprived. It makes me feel sad. It makes me feel very angry.

Andrew suffered a massive brain injury in August. He and his older brother and sister were placed in the custody of Krajian and her husband, Peter, just one year before.

“We, at that time, had tried to get custody of the kids, and for whatever reason DHS wouldn't even respond to our calls or anything,” Richie said. “They were placed with... that.”

Krajian told detectives she was not in the room when Andrew was hurt, but she believed the toddler fell or did a backflip off the living room couch and hit his head.

Krajian's attorney argued it is possible Andrew landed on the stone fireplace or that his 6-year-old brother pushed him off the couch.

A Broken Arrow detective and a pediatrician who treated Andrew both testified that those stories don't match up.

Dr. Sarah Passmore told the judge a fall would not have caused Andrew's brain to bleed and swell the way it did -- and a 6-year-old wouldn't be strong enough to inflict such a severe injury.

The doctor's diagnosis was abusive head trauma.

Andrew was in the hospital for five days before he died.

“To hear the stories of the way this baby had to suffer, the stuff that he went through, would upset anybody,” Richie said. “She had no look of remorse whatsoever.”

Krajian's attorney claimed none of the evidence puts her client in the room when Andrew was hurt.

Mallory claimed her husband was asleep when Andrew was injured. Peter was not charged in the case, but he was convicted in December 2014 of abusing one of Andrew's siblings. He was given a four-year suspended sentence and did not serve any prison time.

Andrew's siblings are now living with a great aunt.
