War veteran and Osage and Pawnee County District Attorney Rex Duncan has his old job back.

Duncan, a former state representative, was elected DA in November 2010, and shortly after taking the office in January 2011, he was notified by the Oklahoma National Guard of his activation for service as a lieutenant colonel.

In March 2011, the Oklahoma Attorney General's office ruled Duncan could not serve as an Oklahoma military officer and as a district attorney.

Duncan stepped down from the job and appointed his first assistant as acting DA for Osage and Pawnee counties.

On April 18, Duncan returned from Afghanistan with the guard's 45th Infantry Brigade.

On May 8, Governor Mary Fallin appointed him to the district attorney job. Duncan has been sworn in again and is expected to take step back into the office this month.
