HOMINY, OKLAHOMA -- A Hominy High School teacher has been accused of raping one of her students.
Shelly Fry, 35, surrendered to the Osage County Sheriff's Office Wednesday afternoon for allegedly engaging in an inappropriate sexual relationship with her student.
"This victim wound up in a unique relationship with this teacher," Charles Cartwright, Chief Criminal Investigator Osage County Sheriff's Office, said.
Investigators said Fry didn't show any emotion when she was taken into custody.
"She was arrested on a probable cause affidavit alleging the crime of second degree rape," Cartwright said.
In the affidavit, the 18-year-old victim told investigators the act happened last fall at Fry's home. It says Fry invited the student over to her home after he told her he needed to get antifreeze for his car.
But when the boy came, the two started watching a movie in the living room before moving into the bedroom. That's when the affidavit says the victim says he and Fry had consensual sex.
Even though it was consensual, prosecutors call it second degree rape because the victim was still a student.
"He basically tells me what happened. I corroborated his statement. I've given her the opportunity to make a statement and of course she took the 5th Amendment Right," Cartwright said.
Fry made an initial court appearance at the Osage County court house. She was booked into the Osage County Jail but bonded out.
Fry's next court date is August 27th.
