DA Grubb Appears Before Multicounty Grand Jury After Failing To Avoid Testimony

After multiple failed attempts to avoid testifying, District Attorney Allan Grubb appeared before the Multi-county Grand Jury.  

The grand jury, according to Grubb’s court filings, is investigating Grubb for alleged “oppression in office and willful maladministration.” Subject matters and meetings of the grand jury are notoriously secretive until their investigations are complete.  

A spokesperson for the State Attorney General Office declined to comment on the investigation earlier this week.  

Grubb and his lawyer, Robert Gifford, claim the grand jury investigation is politically motivated. Gifford told News 9 yesterday that they planned to appear and “oppose” Grubb’s court-ordered questioning.

Grubb was inside the AGO, where the grand jury meets, for over two hours Thursday morning. When asked, Grubb cooperated with the grand jury’s questioning, Gifford declined to answer.  

“I can’t say simply because to honor the parameters of the grand jury, everything has to stay within the grand jury,” Gifford said. “The appropriate thing for me to say is that Mr. Grubb is complying with the law and the court’s directives.”  

This week Grubb attempted twice to have the State Supreme Court quash the Multi-county Grand Jury subpoena to testify, arguing the body did not have jurisdiction. The court refused to intervene and set a date in August for Grubb and his attorneys to make their argument on jurisdiction.  

In September, the Oklahoma State Auditor & Inspector is auditing Grubb, whose district covers Pottawatomie and Lincoln counties, after a request from the District Attorneys Council. The audit is ongoing.  

Grubb’s office fell behind on payments to the DAC, which handles payroll for district attorneys, to the tune of $678,198 in Sept. 2021. His office still owes $250,677.68, according to DAC Executive Coordinator Kathryn Brewer.  

Gifford said Grubb fired a staff member in charge of his office finances after learning of the debt.  

The DAC and Grubb made an agreement on recovering the missed payments in September. Grubb downsized his staff and immediately sent money in his office’s Drug Asset Forfeiture fund to the DAC. “At the time he believed he would pay off the balances by June 30, 2022,” Brewer told News 9.  

Agents with the Oklahoma State Bureau of Investigation are also looking into the financial state of Grubb's office, according to The Oklahoman.
