Judge Clifford Smith granted the motion submitted by 16-year-old Terry Buckley Jr.'s attorney to dismiss the murder charges on Tuesday.

Tulsa County court documents said the State failed to present sufficient evidence at the preliminary hearing that Buckley Jr. met the requirements for first-degree murder.

Buckley said he was not involved in the murder and the judge agreed.

He was originally charged with first-degree murder, shooting with intent to kill, and first-degree robbery for the shooting that happened on June 2nd.

Officers said Terry and his 17-year-old cousin at the time Treston Buckley went to the victims' homes to trade guns with them but during the exchange, the victims were shot.

Investigators said a 34-year-old man was killed, and his 16-year-old son went to the hospital with life-threatening injuries. The current condition of the 16-year-old is not known.

The Buckley cousins were named suspects by Tulsa Police and turned themselves in on June 7th. News On 6 was there when they surrendered at the Tulsa County jail with family surrounding them.

"Yeah, I'm innocent," said Terry Jr. that day. "Ain't nobody bring me here. I surrendered myself."

Terry Jr.'s parents shared their side of the story as well.

"Don't judge what Facebook says. Don't go off of what people post," said Latoya Teague, Terry Buckley Jr.'s mom. "Don't say that, 'cause it's not all like it seems. It's not like it seems. Cause if you don't know, you weren't there, don't do that cause you don't know. You don't know."
