A man accused of first-degree murder is in custody in connection with a deadly shooting in Sapulpa on July 4.
The U.S. Marshals Service arrested Drake Heath for the shooting death of Brandon Terrell Smith, 32, near 420 N. Johannes Street around 4 p.m. that day.
Sapulpa Police said Smith was found dead in the street with a gunshot wound to the chest. Originally, police arrested and accused Bogi Maxwell of the murder, but according to court records, the murder charge has been dismissed.
Detectives said evidence showed that Maxwell was at the victim's house before the murder. Cell phone records show him talking to Smith before the murder. However, new information from witnesses provided evidence that Heath later went to Smith's home and is the one who committed the murder, authorities say.
Maxwell is still facing the charge of felon in possession of a firearm.
The original arrest affidavit said detectives spoke with neighbors who reported seeing Smith speaking with a man beside a black car with the trunk open around 2 p.m. on July 4. The neighbor told detectives he left and came back home around 2:42 p.m., and Smith was lying on the ground while the car was gone. The affidavit noted that the neighbor did not know Smith was dead at that time.
One witness told authorities his son heard a "pop" sound similar to a gunshot around 2:30 p.m.
