OKLAHOMA CITY – The Medical Examiner's Office has ruled an assault-related death from 2009 to be a homicide.

Police were called to 1306 W. I-240 Service Road in reference to an assault on May 30, 2009.

Officers said it started out as a civil matter between two men that escalated into a fight. The suspect reportedly hit the victim, 49-year-old Russell Hoegger, with his fist. The victim fell to the ground, hit his head and was taken to an area hospital in critical condition.

Hoegger died a few days after the assault.

Wednesday, the M.E.'s Office said the cause of death has been ruled a homicide.

Police will not release information about the suspect unless the D.A. decides to press charges.
