A former Oklahoma County district judge accused of sexually assaulting three women will not be charged, a special prosecutor determined.

The special prosecutor, Jason Hicks, was asked to assist and prosecute the case by Oklahoma County district attorney David Prater after accusations mounted against district judge Tim Henderson. Prater also asked for the Oklahoma State Bureau of Investigation's assistance.

The investigation began in 2021 when claims of sexual misconduct by three female attorneys were unearthed. Henderson was suspended and later resigned his post.

In the report, Hicks said it was clear Henderson "preyed on young women whom he believed would respond in his favor," but a review by an OSBI agent and other prosecutors found that "those instances do not have the evidence necessary to prove that a crime occurred."

"Based upon the investigation conducted into Henderson, it is obvious that he violated the trust of the public, and our profession, and as such should NEVER be allowed to practice law again," Hicks concluded in the report.

Henderson began his tenure as an Oklahoma County judge in 2012.
