A judge has dismissed a murder charge against a 15-year-old boy who had been accused of killing his uncle in June of 2022.
According to Mayes County Deputies, the boy's father and uncle got into a fight at Fort Gibson Lake. An affidavit says the boy told officers that he wanted to break up the fight between the two men, so he loaded a rifle. The boy told authorities that he wasn't paying attention to where it was pointed and pulled the trigger.

His uncle, Michael Noyes, was hit in the chest and later died. A woman was also shot in the back, but survived.
The District Attorney has dropped the murder charge pending further investigation.
