70-Year-Old To Stand Trial In Deadly Crash That Killed Moore Teen In May

A 70-year-old woman will stand trial in the death of a Moore teen after she crashed into the victim in May.

A 70-year-old woman will stand trial in the death of a Moore teen. 

Judy Todd is facing first-degree manslaughter charges after she crashed into Kolby Dutton in May. 

In Cleveland County court Monday, a judge made the decision to pursue a criminal trial in the case. 

News 9 spoke with Kolby's sister and mother Tuesday about their continuous fight for justice, and their hope that this will bring accountability for Kolby's alleged killer. 

"As sad as the justice will be for her and her family- it needs to be done," Kathy Chavez, Kolby's mother, said.

“Unfortunately, that means that Mrs. Todd will be found guilty of manslaughter and that is a heavy, heavy burden to carry.”

The probable cause affidavit stated the vehicle driven by Todd “pulled out of a private drive and failed to yield to oncoming traffic.”

It goes on to say, “Todd told officers on the scene she took two prescription medications - hydrocodone and gabapentin.” 

Kolby was a Westmore High School student who was on track to graduate in May 2023. 

He was riding on a motorcycle that collided with the SUV that Todd was driving near Southwest 107th and Western. 

Police told News 9 on the day of the crash that Todd pulled out of a private driveway into Kolby's path. 

Kolby, who was wearing a helmet, died on the scene.

“Not only did she take my brother, she took my best friend, she took the person who was going to be walking me down the aisle this October," Kasey, Kolby’s sister, said. 

Kasey and Kathy said while they have felt a rollercoaster of emotions, they said anger is not one of them.

“We are not doing this to hurt her, we are doing this to be able to have my brother rest in peace," Kasey said.

“I think the grief of losing my son is too overwhelming to feel anything but sadness for everyone," Kathy said.

Kolby's family said he touched so many people in his short time, and they know his positive memory will continue to live on.

“I am so proud of him for who he was and who he is because he's still touching people," Kathy said.

Kolby’s family has also filed a civil lawsuit.
