A man charged with first-degree murder in a road rage shooting in Norman last summer requested to have his charges dismissed. 10 days ago, a judge denied Mark Kottka's request.
Now, Kottka's attorney is appealing that ruling, meaning the case is on hold until it's all sorted out.
Kottka is accused of shooting and killing Christian Gurrola in a road rage incident along Main Street in Norman last July.
Police say Kottka was the aggressor -- while his attorneys claim it was self-defense.
Kottka is charged with first-degree murder.
His attorneys have also argued that it should be amended to manslaughter, but a judge denied that request too.
