State Superintendent Ryan Walters is asking a Tulsa County judge to dismiss a libel lawsuit filed against him by Bixby Superintendent Rob Miller.

State Superintendent Ryan Walters is asking a Tulsa County judge to dismiss a libel lawsuit filed against him by Bixby Superintendent Rob Miller.

The superintendent filed the lawsuit after Miller criticized Walters for not releasing state funding to the school.

Walters said that wasn't true and then called Miller a clown and a liar at a July news conference.

"He knows every year when he gets the Title One funds, and we're dealing with all kinds of financial problems with his district that we're hoping to address right now. So you know, Rob's a clown and a liar. So he knows that."

Walters says the lawsuit should be dismissed because he was acting in his official capacity as a state employee.

He also says Miller can't prove Walters was directing his comments toward him.
